CONSTITUTION of the Burnaby Coed Slo-Pitch League
1. NAME OF LEAGUE
BURNABY CO-ED SLO-PITCH LEAGUE
2. PURPOSE OF THE LEAGUE
2.1 To promote the game of Slo-pitch in the Burnaby area.
2.2 To have its teams be members of recognized regional Slo-pitch associations.
2.3 To offer organized and structured league competition in Slo-pitch.
3. EXECUTIVE
3.1 The Management of the league is by the LEAGUE EXECUTIVE.
3.2 The league of office for executive members is two (2) years ending on the first meeting of the next year. Except for the president's term, this will consist of four (4) years. If the president chooses not to run for another term, they will act as past president for four (4) years, in a non-voting capacity.
3.3 The league executive shall consist of president, vice president, secretary, treasurer, and scorekeeper.
3.4 Any executive member may, by notice in writing, resign at any time and that executive member's office shall become vacant. The executive is then empowered to appoint an individual to that vacant position until the next Annual General Meeting.
3.5 Any executive member can be removed from office by resolution at any league meeting with a 50%+1 vote.
4. POWERS OF EXECUTIVE
4.1 The executive shall have the power to control the affairs of the league.
4.2 The executive shall have the power to make rules and regulations governing players, age limits, schedules, playoffs, league structure, league tournaments, umpires and other relevant and incidental matters necessary to the operation of the league.
4.3 To make, adopt and vary the constitution, rules and conditions for the running of the league and to take all such steps as shall be deemed necessary or advisable for the enforcing of such rules and conditions.
4.4 The business of the league shall be managed by the executive, who pay all expenses incurred in setting up and running the league and may exercise all such powers of the league. The executive is not held personally responsible for financial and/or personal losses incurred by the league.
5. MEMBERSHIP
5.1 Membership in the league shall be open to teams as approval by the league executive.
5.2 A team may apply to the league executive for membership in the league and on acceptance by the league executive shall be a member.
5.3 Every member shall uphold and comply with the constitution and rules of the BCSL.
5.4 League executive shall determine the amount of league fees.
5.5 A membership in the league shall be cancelled upon:
5.5.1 Being expelled.
5.5.2 Delivery of a written resignation to the league executive.
5.6 A member or team may be expelled by resolution of the league executive passed at any league Executive meeting.
5.6.1 The member or team has the right to an opportunity to be heard at the meeting should they be present, otherwise the expelled member or team has the right to one appeal hearing before the appeal board.
5.7 Any persons suspended or expelled shall have the right to one appeal in writing within seven Calendar days from the date of the suspension.
5.8 Appeals of discipline, suspension and expulsions will be heard by an appeal committee consisting of three (3). The league president or the league president's appointee will act as appeal committee Chairperson. The league executive shall appoint one member, (other than a member of the Executive). The appealing party shall appoint one representative. All appointed shall be a member In Good standing within the league. The committee's decision is final.
5.9 All members are in good standing except a member who has failed to pay their current league fees Or any other debt due and owing by them to the league and they are not in good standing so long as the debt remains unpaid.
5.10 All new teams and teams with new ownership will be on one year probation.
6. LEAGUE MEETINGS
6.1 The league president, or in their absence, the vice president, or in the absence of both, some member of the league executive, shall preside at all meetings of the league and league executive.
6.2 A quorum (50%+1) at any meeting shall be a majority of members in good standing attending the meeting. Each member shall have one (1) vote at meetings.
6.3 If when the meeting is called to order there is not a quorum present, the meeting shall be adjourned until a quorum is reached or thirty (30) minutes has passed, at which time the number of members in good standing present shall be considered a quorum.
6.4 In case of an equality of votes, the chairperson will cast the deciding vote.
6.5 Voting is by show of hands or poll by team as chosen by the chairperson.
7. FEES
7.1 The executive in such amounts shall determine all fees, as the executive deems necessary for the continued operation of the league.
8. PERFORMANCE BONDS
8.1 All teams must post a non-interest bearing $150.00 performance bond on or before the second league meeting of each new season. The league executive will notify all teams as to the exact date.
8.2 Bonds will be held to carry over to following year. A team leaving the league shall be refunded what is left in their bond. Any team incurring fines will be required to pay the necessary funds in order to maintain their $150.00 performance bond. This payment will take place when league fees are due.
8.3 Performance bonds shall be forfeited to the league for:
8.3.1 Failure to complete league obligation of participation.
8.3.2 Payment of fines assessed by the league.
8.3.3 Payment of special assessments as approved by the league executive.
9. FINES
9.1 Automatic fines shall be levied for:
9.1.1 Failure to have a team representative attend league meetings - $25.00
9.1.2 Defaulted games without a minimum seven day confirmed notice to the league email burnaby.coed@gmail.com results in a $50.00 fine
9.1.2.1 Default of a regular season game - $50.00
9.1.2.2 Default of playoff games could result in ejection from playoffs and/or being expelled from the league
9.1.3 Failure to complete a game due to player ejection - $20.00
9.1.4 Failure to submit a copy of S.P.N. roster by season start online to league executive - $25.00 per week.
9.1.5 Failure to return any equipment to there proper places whether a tourney or league play - $50.00 or the cost of the equipment.
9.1.6 Use of a banned bat:
9.1.6.1 1st offence in a regular season game - $50.00
9.1.6.2 2nd offence in a regular season game - $100.00
9.1.6.3 3rd offence in a regular season game will result in being expelled from the league for one (1) year
9.1.6.4 1st offence in a playoff game will result in ejection from playoffs
9.2 Use of alcohol in unauthorized areas:
9.2.1 1st offence - $250.00
9.2.2 2nd offence will result in being expelled from the league
9.3 Fines to a maximum of $250.00 may be assessed by the league executive or appeal committee as Part of a disciplinary action against any team or player. This does not limit the League executive from assessing any team or player for damage to or loss of property used or owned by the league.
10. DISCIPLINE
10.1 The league president or their appointee shall have full powers to decide all discipline levels, up to and including league expulsion and fines to a maximum of $250.00. Each incident shall be taken on its own merit and past practice need not apply. This does not limit the league from assessing disciplinary action.
10.2 The purpose of discipline is to correct behavior, not punish. It must also protect the league members from repercussions due to actions of an individual and or/ group of people.
10.3 The following actions must be considered serious violations of the rules and discipline must indicate this seriousness:
10.3.1 Fighting or threatening actions.
10.3.2 Damaging public, private or league property.
10.3.3 Intentional or continual dangerous play.
10.3.4 Use of alcohol in unauthorized areas.
10.3.5 Failure to correct undisciplined behavior.
10.4 League executives are players and volunteers. Abuse directed at these individuals will not be tolerated.
10.5 Official complaints are to be submitted in writing to any member of the executive of the league.
10.6 Persons must serve their game suspensions immediately after executive notification.
11. APPEALS AND PROTESTS
11.1 Coaches and managers or team representatives may appeal in writing to the league executive. A certified cheque or cash must accompany all such appeals for $100.00. This money will be returned if the appeal is found to be in favor of the appealing party.
11.2 Protests will be handled as outlined in the playing operating rules of SPN
12. AMMENDMENTS
12.1 This constitution may be amended where allowed by a 50%+1 vote of the Team Representatives present in person at any meeting of the league. Only one (1) representative per team is entitled to vote.
13. ALTERATION OF THE CONSTITUTION
13.1 Amendments to the constitution shall be made by recommendation only from team representatives Or from the executive.
14. ALLOCATION
14.1 The league executive will design the league's divisional structure attempting to create as competitive inter-divisional play as possible. These divisions will be designed based on previous year's standings, a team's ability, and the knowledge of player movement within the league. The league executive will have the final decisions.
14.2 You have to register with S.P.N. in whatever classification your team chooses.
15. REGISTRATION
15.1 All players, coaches, managers and team personnel must be registered with the league and S.P.N.
15.2 The purpose of mandatory registration with S.P.N. is for insurance purposes. It is each team's responsibility to ensure all team personnel are covered by additional liability insurance, which covers the activities involved in participating in the association. Failure to ensure that player's are registered with S.P.N. will result in a minimum fine of $200.00 and/ or expulsion of the representative, coach and/or team for a period to be decided by the executive.
15.3 Rosters to consist of a maximum of 40 players.
15.4 S.P.N. team roster(s) (on original form) to completed online before the seson starts
15.5 Players must be registered at S.P.N. or Softball B.C. level C or lower otherwise they will be deemed to be an illegal player. No players registered with S.P.N. or Softball B.C. at and or above B level are allowed in the league.
15.6 In the event of illegal player protest, the player under protest must produce picture ID to the coach of protesting team.
16. DISSOLUTION
16.1 In the event of dissolution of the league the assets of the league shall be split equally among its current team representatives excluding any team on probation.
16.2 Dissolution shall require unanimous vote of the league executive; this condition shall be unalterable.
17. REGULAR SEASON STANDINGS
17.1 The overall win record determines standings.
17.1.1 Two points for a win. One point for a tie. Zero points for a loss and minus one point for default.
17.2 Ties in standings are broken by:
17.2.1 Greatest number of wins. If still tied go to 17.2.2
17.2.2 Record between team's tied. Scores revert back to last completed Inning for both teams. If there are more than two teams tied the record between the teams tied only in effect if they have played the same amount of games vs each other. If still tied or rule ineligable go to 17.2.3
17.2.3 Greatest run differential in games played against eachother if eligable. If still tied or ineligable go to 17.2.4
17.2.4 Greatest run differential for all regular season games. If still tied go to 17.2.5
17.2.5 Greatest number of runs scored. If still tied go to 17.2.6
17.2.6 Least number of runs scored against. If still tied go to 17.2.7
17.2.7 Coin toss.
17.3 Teams must have a copy of all score sheets signed by the umpire.
17.4 Winning team to input on website, call in or E-MAIL score within 24 hours or loss by default. No exceptions. Home team calls in ties. No appeals of this by-law if infringed. Both teams are accountable to ensure the score is entered accurately.
